This website is operated by Gone Country Couture ("we", "us", "our"). Throughout the site, "Services" refers to our website, sales channels (including Facebook/Instagram Shop and TikTok Shop), in-person POS, and any related features or apps we use to operate the store.

By visiting our site and/or purchasing something from us, you agree to be bound by these Terms of Service ("Terms"), including additional terms and policies referenced here or available by hyperlink (collectively, the "Agreement"). These Terms apply to all users of the site.

Our store is hosted on Shopify, which provides the e-commerce platform we use to sell our products and Services.

1. Online Store Terms

You represent that you are at least the age of majority in your state of residence, or you are the age of majority and have given consent for your minor dependents to use this site. You may not use our Services for any illegal or unauthorized purpose nor violate any laws (including intellectual-property laws). You must not transmit any worms, viruses, or destructive code. A breach of these Terms may result in immediate termination.

2. General Conditions

We reserve the right to refuse Service to anyone for any reason at any time. Content (excluding credit-card data) may be transferred unencrypted over various networks and adapted to technical requirements. Credit-card and payment data is always encrypted in transit by our payment providers. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service without our written permission.

3. Accuracy, Completeness & Timeliness

Site content is provided for general information and may not be accurate, complete, or current. We may modify site content at any time with no obligation to update information. Your use of content is at your own risk.

4. Modifications to the Service & Prices

Prices and product availability are subject to change without notice. We may modify or discontinue the Service (or any part of it) at any time. We are not liable to you or any third party for modification, price change, suspension, or discontinuance.

5. Products & Services (Online Only)

Some products/services may be available exclusively online and may have limited quantities. Returns and exchanges are handled according to our Return & Exchange Policy available at gonecountrycouture.com/policies/refund-policy.

We attempt to display colors and images accurately but cannot guarantee your screen's display.

We may limit sales by person, household, region, or jurisdiction; limit quantities; change descriptions; discontinue products; or refuse orders at our discretion.

6. Billing & Account Information

We may refuse or cancel any order. We may limit or cancel quantities per person, household, or order (including orders using the same account, card, or address). If we change or cancel an order, we may attempt to notify you via the email/phone/billing address provided.

You agree to provide current, complete, and accurate account and purchase information and to promptly update your info so we can complete transactions and contact you as needed.

7. Optional Tools & Apps

We provide access to third-party tools (the "Apps") as-is and as-available without warranties or endorsement and with no liability. You are responsible for reviewing and agreeing to each App provider's terms. Current Apps we use include (subject to change): Yanet Return and Exchange, Shopify Flow, Tagify, Essential Countdown Timer, TikTok Shop, Facebook & Instagram Shop, Shopify POS, Faire/Trendsi/FashionGo/Hubventory (sourcing/wholesale).

8. Third-Party Links

Third-party links may direct you to sites not affiliated with us. We are not responsible for examining or evaluating such content and have no liability for third-party materials, websites, products, or services. Review third-party policies before engaging in transactions or sharing information.

9. User Content (Comments/Reviews/UGC)

If you submit content (e.g., reviews, photos, ideas, proposals, social tags), you grant us a non-exclusive, royalty-free, transferable, sublicensable, worldwide license to use, reproduce, publish, distribute, translate, adapt, and display such content in any media. We have no obligation to (1) keep comments confidential; (2) compensate you; or (3) respond.

You are solely responsible for your content and represent it does not violate any rights or laws, contain malware, or mislead others. We may monitor, edit, or remove content at our discretion.

10. Personal Information & Privacy

Your submission of personal information through the store is governed by our Privacy Policy available at gonecountrycouture.com/policies/privacy-policy.

11. Errors, Inaccuracies & Omissions

Occasionally information on our site may contain errors or omissions (e.g., product descriptions, pricing, promotions, shipping charges, transit times, availability). We reserve the right to correct and update information or cancel orders if any information is inaccurate at any time (including after submission).

12. Prohibited Uses

In addition to other prohibitions in these Terms, you may not use the site or its content: (a) for unlawful purposes; (b) to solicit others to perform unlawful acts; (c) to violate regulations, rules, laws, or ordinances; (d) to infringe IP rights; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate; (f) to submit false/misleading info; (g) to upload malware; (h) to collect or track personal information without consent; (i) to spam/phish/pharm/pretext/spider/crawl/scrape; (j) for obscene/immoral purposes; or (k) to circumvent security features. We may terminate your use for violations.

13. Shipping, Title & Risk of Loss

Orders ship to the address you provide. Title and risk of loss pass to you upon delivery to the carrier. Shipping dates/ETAs are estimates and not guarantees. We are not responsible for delays or issues caused by carriers, customs, weather, or factors beyond our control.

14. Preorders, Backorders & Dropship Items

From time to time we may offer preorder/backorder items or items fulfilled by wholesale/dropship partners (e.g., Faire, Trendsi, FashionGo, Hubventory). Estimated ship dates are best estimates and may change based on supplier availability or demand. If an item cannot be fulfilled within a reasonable period, we will offer an update, alternative, or cancellation/refund per our Return & Exchange Policy.

15. Returns & Exchanges

We support returns and exchanges through our Exchange Portal at gonecountrycouture.com/apps/exchange. Return windows, eligibility, and methods are governed by our Return & Exchange Policy available at gonecountrycouture.com/policies/refund-policy. Some items (e.g., final-sale items from our Sale Collection) may be non-returnable; see policy for details.

16. Payments & Financing

We accept Shop Pay / Shopify Payments, PayPal, Google Pay, Venmo, and Afterpay (buy-now-pay-later). Use of any payment method is subject to the provider's own terms and eligibility—e.g., Afterpay's installment terms and late-fee policies. By choosing one of these options you agree to the applicable provider's terms.

17. Intellectual Property

All content on the Services (text, graphics, logos, images, software, code, and compilations) is our property or licensed to us and protected by applicable laws. You may not use our trademarks, trade dress, or copyrighted works without written permission.

18. Disclaimers; Limitation of Liability

We do not guarantee uninterrupted, timely, secure, or error-free Service. The Service and all products are provided "as is" and "as available" without warranties of any kind, express or implied (including merchantability, fitness for a particular purpose, durability, title, non-infringement).

In no case shall Gone Country Couture or our officers, directors, employees, affiliates, agents, contractors, suppliers, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, or any lost profits/revenue/savings/data, arising from your use of the Service or products. Where limitations are not permitted, liability is limited to the maximum extent allowed by law.

19. Indemnification

You agree to indemnify, defend, and hold harmless Gone Country Couture and our affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees from any claim or demand (including reasonable attorneys' fees) made by any third party due to or arising out of your breach of these Terms or your violation of any law or third-party rights.

20. Severability

If any provision is unlawful, void, or unenforceable, that provision is severed to the extent necessary and does not affect the validity of remaining provisions.

21. Termination

These Terms remain in effect unless terminated by you or us. You may terminate at any time by ceasing to use the Services. If we believe you breached these Terms, we may terminate immediately and you remain liable for amounts due up to the termination date.

22. Governing Law; Venue

These Terms and any separate agreements whereby we provide you Services are governed by the laws of the State of Idaho, without regard to conflict-of-laws rules. You agree to exclusive jurisdiction and venue in the state and federal courts located in Ada County, Idaho.

23. Dispute Resolution; Arbitration

At our or your election, any dispute arising out of or relating to these Terms or the Services shall be resolved by binding arbitration administered by the AAA under its Consumer Arbitration Rules. You and we waive class actions and agree to individual claims only. You may opt-out of arbitration within 30 days of first use by emailing deanna@gonecountrycouture.com with subject "Arbitration Opt-Out."

You can review the most current version of the Terms at any time on this page. We may update these Terms by posting revisions here. Your continued use of the Services after changes are posted constitutes acceptance.
